JUSTICE HEMANT KUMAR SRIVASTAVA ORAL ORDER 04-11-2019 Heard learned counsel appearing for the petitioner as well as learned Additional Public Prosecutor for the State. Petitioner seeks bail in a case registered for the offences punishable under Sections 272 and 273 of the Indian Penal Code and Section 47(a) of the Excise Act. Eighty liters country-made liquor is said to have been recovered from the house of the petitioner and, accordingly, the petitioner was made accused in old Excise Act. However, petitioner is in jail custody since 27.8.2019 and submissions on behalf of the petitioner is that nothing was recovered from the house of the petitioner and as a matter of fact, the petitioner was not present in his house at the time of alleged recovery rather he was outside the State in connection with his livelihood and when he returned to his home, he came to know about the institution of the present case and,
Patna High Court CR. MISC. No.66501 of 2019(2) dt.04-11-2019 2/2 accordingly, he himself surrendered before the trial court. Considering the aforesaid facts and circumstances as well as submissions of the parties and also taking note of the fact that petitioner does not have any criminal antecedents, let the petitioner, above named, be released on bail on furnishing bail bond of Rs. 10,000/- (Ten Thousand) with two sureties of the like amount each to the satisfaction of learned 2nd Additional Sessions Judge, Sheikhpura/concerned court in connection with Excise Case No. 555/17 arising out of Barbigha P.S. Case No. 337/2015.
