====================================================== CORAM: HONOURABLE MR. JUSTICE RAJENDRA KUMAR MISHRA ORAL ORDER ------------- 15-12-2017 Heard learned counsel for the petitioner and the learned A.P.P. for the State.

The petitioner apprehends his arrest in connection with Kochadhawan P.S. Case No.120 of 2017 registered under Sections 409 and 420 of the Indian Penal Code.

The accusation is that the petitioner being the ExMukhiya of Majkuri Gram Panchayat and Ramnath Malakar, the then Panchayat Secretary, Kochadhaman, misappropriated Rs.6,94,000/- allocated for the Gram Panchayat Majkuri under Seven Schemes.

Learned counsel for the petitioner submits that, in fact,

No.57594 of 2017 (2) dt.15-12-2017 2/2 the petitioner is the Ex-Mukhiya of Majkuri Gram Panchayat and after receiving the letter regarding the defalcation of Rs.6,94,000/-, allocated under Seven Schemes, the petitioner deposited Rs.6,66,385/- on different dates in the account of the concerned Gram Panchayat, which would appear from Annexure2 series to this application. The petitioner undertakes that he would deposit the remaining amount of Rs.28000/- in the account of the concerned Gram Panchayat very soon.

Having considered the facts and the circumstances of the case, let the petitioner, above named, in the event of his arrest or surrender by him within six weeks from today, be enlarged on bail on his furnishing bail bond of Rs.10,000/-(Rupees Ten Thousand) with two sureties of the like amount each to the satisfaction of the Additional Chief Judicial Magistrate-I, Kishanganj, in connection with Kochadhaman P.S. Case No.120 of 2017, subject to the conditions laid down under Section 438(2) Cr.P.C., on showing the receipt of depositing of Rs.28,000/- in the account of the concerned Gram Panchayat.
