The petitioners are apprehending their arrest in a case registered for the offences punishable under Sections 147, 149, 341, 323, 427, 353, 332, 308 of the Indian Penal Code.

The prosecution case is that while one of the thieves making attempt to commit theft in the office of the Sub-Divisional Office, Sherghati tried to escape on a motorcycle, when the informant chased him on police jeep, but these petitioners leading the idol immersion procession intervened as a result the alleged thieves escaped.

It is submitted by the learned counsel for the petitioners that the petitioners were part of idol emersion procession hence,

Patna High Court Cr.Misc. No.56520 of 2015 (2) dt.14-12-2015 maliciously the petitioners have been roped in the present case. Considering the nature of accusation against the mob, let the above named petitioners be released on bail in the event of their arrest or surrender before the learned court below within a period of twelve weeks from today, on furnishing bail bonds of Rs. 10,000/- (Ten Thousand) each with two sureties of the like amount each to the satisfaction of learned SubDivisional Judicial Magistrate, Sherghati in connection with Sherghati P.S. Case No. 274 of 2015, subject to conditions as laid down under Section 438(2) of the Code of Criminal Procedure.
