The petitioners apprehend their arrest in connection with Barahara P.S. Case No. 228 of 2016 registered under Sections 147, 148, 149, 341, 323, 307, 324, 504, 506/34 of the I.P.C. and 27 of the Arms Act pending in the Court of C.J.M., Ara, District - Bhojpur.

Learned counsel appearing on behalf of the petitioners submits that there is case and counter case between the parties for the land dispute. Not even a single witness has supported the prosecution case.

Patna High Court Cr.Misc. No.54388 of 2016 (7) dt.04-04-2017 2/2 vehemently opposed the prayer of the petitioners with submission that although it is a case and counter case, but the informant's side received gun shot injuries caused by the petitioners' side with intention to kill them, which are grievous in nature. Having considered the facts and circumstances of the case and nature of the allegation, I am not inclined to allow the prayer of the petitioners for anticipatory bail. Accordingly, this application is rejected.
