JUSTICE VINOD KUMAR SINHA ORAL ORDER 18-01-2017 The petitioner is apprehending his arrest in connection with C-2A-9/16, registered for offences punishable under Section 47(A) Excise Act.
It has been submitted on behalf of the petitioner that thought there is allegation of recovery of 70 litre of countrymade and foreign liquor was recovered, the same was not recovered from the shop of the petitioner rather the alleged recovery has been made from another shop situated beside the petitioner's shop. The petitioner has been running an electrical shop and has nothing to do with the alleged recovery, he has been implicated in this case only on the basis of suspicion.

Having heard both sides, in view of the fact that nothing

No.939 of 2017 (2) dt.18-01-2017 2/2 has been recovered from the possession of the petitioner rather the same was recovered from another shop situated beside the shop of the petitoner, let the petitioner above named, in the event of his arrest or surrender before the court below within a period of four weeks from the date of receipt/production of a copy of this order, be enlarged on bail on furnishing bond of Rs. 10,000 (Rs. Ten Thousand) each with two sureties of the like amount each to the satisfaction of CJM, Vaishalil at Hajipur in connection with case No. C-2A-9/16 subject to the conditions as laid down under Section 438(2) of the Cr.P.C.
It is also with the condition that the petitioner shall cooperate in the investigation and make himself available as and when required by the police.
It is made clear, if in future the petitioner is found involved in any of the said act, the prosecution will be free to move for the cancellation of bail bond of the petitioner. (Vinod Kumar Sinha, J) sunil/- U
