The petitioner seeks regular bail in a case registered for the offence punishable under Sections 307, 302, 120(b), 34 of the Indian Penal Code and Section 27 of the Arms Act. Earlier prayer for regular bail has been rejected vide order dated 20.11.2018 in Cr. Misc. No. 60925 of 2018 by the Coordinate Bench of this Court with a direction to the court below to expedite the trial and made effort to conclude the same as early as possible preferably within a period of nine months from the date of receipt/production of this order, the petitioner is given liberty to renew his prayer for bail after nine months in the event, no substantive progress is made in trial. The allegation against the petitioner and other accused persons are of indiscriminate firing on the deceased.

Patna High Court CR. MISC. No. 59833 of 2019(3) dt.06-02-2020 2/2 Learned counsel for the petitioner submits that the co -accused Pawan Mandal has been granted bail by the Coordinate Bench of this court vide order dated 03.02.2020 in Cr. Misc. No. 3563 of 2020. The petitioner is in custody since 11.07.2018 and has got no criminal antecedent. There is no allegation of tampering of witnesses alleged against the petitioner.

Considering the aforesaid facts and circumstances, let the petitioner, above named, be released on bail on furnishing bail bond of Rs. 25,000/- (rupees twenty five thousand) with two sureties of the like amount each to the satisfaction of the learned A.D.J.-02nd, Banka, in connection with Banka Amarpur P.S. Case No. 342 of 2018, subject to the following condition that the petitioner will cooperate in disposal of trial and make himself available as and when required by the court below, failing which, the prosecution shall move for cancellation of his bail bonds.
