2. The petitioner seeks bail in a case registered for the offence punishable under Sections 147, 149, 341, 323, 307, 354, 379, 504 and 506 of the Indian Penal Code.
3. As per the prosecution case, this petitioner assaulted on the head of informant with iron rod and thereafter, took away his gold chain. It is further alleged that other accused persons assaulted family members of informant due to which, wife of informant died during course of treatment.
4. It is submitted by learned counsel for the petitioner that petitioner is quite innocent and has committed no offence. Petitioner is not the assailant of the deceased. Similarly situated co-accused persons have already been granted bail by this
Patna High Court CR. MISC. No.68416 of 2025(3) dt.19-12-2025 2/2 Hon'ble Court vide order dated 06.12.2024 passed in Cr. Misc. No. 57690 of 2024. Moreover, charges have already been framed against this petitioner on 19.02.2025 and petitioner, having clean antecedents, is in custody since 06.06.2024.
5. Learned A.P.P. for the State has vehemently opposed the prayer for grant of bail to the petitioner.
6. Considering the facts and circumstances of the case, fact that petitioner is not the assailant of the deceased, claim based on parity, clean antecedents of the petitioner and period of custody, the prayer for grant bail of to the petitioner is allowed.
7. Accordingly, let the above named petitioner be released on bail on furnishing bail-bond of Rs. 10,000/- (ten thousand) with two sureties of the like amount each to the satisfaction of learned District and Additional Sessions Judge, Dalsinghsarai, Samastipur in connection with Dalsinghsarai P.S. Case No. 177 of 2023.
