====================================================== CORAM: HONOURABLE DR. JUSTICE RAVI RANJAN ORAL ORDER 20-01-2016 I have heard learned counsel for the petitioner and the State.
The petitioners apprehend their arrest in connection with Rahui P.S. Case No. 333 of 2015 registered for offences punishable under Sections 341, 323, 324, 379, 504, 506, 307, 325/34 of the Indian Penal Code.
As per the allegation Petitioner No. 1 Putus Choudhary has assaulted the informant by "Fasuli" which is a sharp cutting weapon causing injury upon his head and others have also assaulted the informant. However, the injuries are merely simple in nature. One is lacerated wound on the parietal region of the head and others are swelling injures. All the injuries
Patna High Court Cr.Misc. No.57347 of 2015 (2) dt.20-01-2016 2/2 are simple in nature. It is contended on behalf of the petitioner that in fact, the petitioners had lend money to the informant. In fact, he was roaming in intoxicated condition and had fallen and due to which he had received injuries. It is submitted that the petitioners are having clean antecedents.
Having regard to the facts and circumstances of the case, let the petitioners, namely, (1) Putus Choudhary, (2) Raja Ram Choudhary and (3) Rambilas Choudhary be released on bail in the event of arrest/surrender before the court below within a period of six weeks from today in Rahui P.S. Case No. 333 of 2015, on furnishing bail bond of Rs.10,000 (Ten Thousand Rupees) each with two sureties of the like amount each to the satisfaction of Sri Swarn Prabhat, Judicial Magistrate 1st Class, Bihar Sharif, Nalanda at Bihar Sharif, subject to the conditions as laid down under sub-section(2) of Section 438 of the Code of Criminal Procedure.
