JUSTICE DINESH KUMAR SINGH ORAL ORDER 09-12-2015 Heard learned counsels for the petitioner and the State. The petitioners are apprehending arrest in a case registered for the offences punishable under Sections 447, 341, 323, 504, 506, 325 and 354B of the Indian Penal Code and Section 3 (I) (X) of the SC/ST (Prevention of Atrocities) Act. It is alleged that the petitioners assaulted the informant with fists and slap and abused by calling caste name. The petitioners wanted to dispossess the informant from the land in question.

It is submitted by learned counsel for the petitioners that the petitioner filed Informatory petition no.6698 of 2014 on 24.12.2014 before learned CJM, Bhagalpur raising apprehension

Patna High Court Cr.Misc. No.56002 of 2015 (2) dt.09-12-2015 2/2 at the hands of the informant and thereafter the present FIR was registered on 28.12.2014.

The aforesaid facts constitute good ground for consideration of prayer for regular bail.

Let the learned court below consider the prayer for regular bail of the petitioners if they surrender within a period of six weeks in connection with Nathnagar P.S. Case No. 341 of 2014 pending in the court of learned CJM, Bhagalpur. Accordingly, the application is disposed of.
