JUSTICE RAJENDRA KUMAR MISHRA ORAL ORDER 15-03-2017 Heard learned counsel for the petitioner as well as learned Additional Public Prosecutor for the State. The report regarding stage of the trial of the petitioner, kept at Flag-"X", has been received through Letter No.14 dated 20.02.2017 from the court of the learned Additional District & Sessions Judge, 3rd , Supaul, which shows that six charge sheet witnesses have been examined and the trail is pending for examination of the remaining charge sheet witnesses. The prayer for bail of the petitioner has already been rejected twice on merit.

The petitioner is in custody since 28.05.2013. As the prayer for bail of the petitioner has already been rejected twice on merit, I do not find any fresh ground to

Patna High Court Cr.Misc. No.5256 of 2017 (3) dt.15-03-2017 2/2 reconsider the prayer for bail. The prayer for bail of the petitioner is again rejected at this stage.

However, learned court below is directed to conclude the trial within six months by taking all effective steps for examining the remaining charge sheet witnesses. If the trial is not concluded within the stipulated period, the petitioner would be at liberty to renew his prayer for bail.
