The petitioner seeks bail in a case registered under Sections 353, 307, 34 of the Indian Penal Code and Section 27 of the Arms Act.

It has been submitted by the learned counsel for the petitioner that the petitioner has falsely been implicated in the case by the police. No specific allegation of firing is made against the petitioner in the F.I.R. The petitioner has been named due to village politics. The petitioner is in jail since 06.08.2015. Learned A.P.P., however, opposed the prayer for bail and submitted that charge has been framed against the petitioner and co-accused Pintu Yadav.

Considering the facts aforesaid and the fact that the petitioner is in jail for more than one and half years, the above

Patna High Court Cr.Misc. No.1226 of 2017 (3) dt.27-02-2017 2/2 named petitioner is directed to be enlarged on bail on furnishing bail bond of Rs. 10,000/- (Ten thousand) with two sureties of the like amount each to the satisfaction of the learned 2nd Additional Sessions Judge, Naugachia, Bhagalpur in Sessions Trial No. 917A/2013, arising out of Kharika P.S. Case No. 51/12, G.R. No. 453/12.
