JUSTICE SAMARENDRA PRATAP SINGH ORAL ORDER 22-01-2016 Heard learned counsel for the petitioner and the State. The petitioner apprehends arrest in a case under sections 364, 302, 201/34 of the IPC.
The informant's son went missing. On enquiry, the informant learnt that previous night there was some altercation between his son and the petitioner and on the following day dead body of his son was found from the well of Ajay Poddar. Learned counsel for the petitioner submits that the informant believes that the petitioner along with others committed murder of his on account of land dispute. He further submits that there is only suspicion against the petitioner. Learned counsel for the State, however, opposes the prayer for anticipatory bail.

No.55690 of 2015 (3) dt.22-01-2016 2/2 Having regard to the facts and circumstances of the case, let the petitioner, as named above, in the event of arrest/ surrender be released on bail on furnishing bail bond of Rs. 5,000/- (five thousand) with two sureties of the lime amount each to the satisfaction of Chief Judicial Magistrate, Bhagalpur in connection with Pirpainti P.S. case No. 252 of 2015, subject to conditions as laid down under section 438(2) of the Code of Criminal Procedure. One of the sureties shall be in the form of cash.
The petitioner would not physically absent for two consecutive dates at a stretch till three witnesses are examined in the trial, failing which his bail bond would be cancelled. (Samarendra Pratap Singh, J) BKS/- U T
