JUSTICE JITENDRA MOHAN SHARMA ORAL ORDER 09-01-2017 Heard the learned counsel for the petitioner as well as the learned A.P.P for the State.

The petitioner seeks bail in a case for the offences punishable under sections 25 (1-b) a and 26 of the Arms Act. Allegedly, from possession of the petitioner one loaded country made katta and four other live cartridges were recovered.

Submission is of false implication and that the petitioner is in custody since 01.08.2016.

The learned A.P.P. submits that earlier also the petitioner was an accused in similar nature of case vide Manpur P.S. Case No. 70 of 2009 and the petitioner has got criminal

Patna High Court Cr.Misc. No.54537 of 2016 (2) dt.09-01-2017 2/2 antecedent as he is involved in ten more cases. In the facts and circumstances as stated above, the petitioner shall be released on bail, after completion of eight months in custody, on furnishing bail bond of Rs. 10,000/- (Ten thousand) with two sureties of the like amount each to the satisfaction of A.C.J.M.-III, Nalanda at Biharsharif in Manpur P.S. Case No. 75 of 2016, subject to the conditions that one of the bailors must be a near relative and another having sufficient immovable property within the territorial jurisdiction of the court concerned and the petitioner shall remain present on each and every date during trial and the default on two consecutive dates on his part without any reason shall disentitle the petitioner from privilege of bail.
