The petitioners are apprehending arrest in a case registered for the offences punishable under sections 341, 323, 324, 304 and 307/34 of the Indian Penal Code. The prosecution case is that the accused persons came armed with 'lathi', 'danda' and 'khanti', chased the informant, started abusing and made assault to him when uncle and aunt of the informant came to rescue, they were also assaulted by the accused persons.
It is submitted by learned counsel for the petitioners that injuries have been found marginal size simple in nature though with regard to some of the injuries opinion has been kept
Patna High Court Cr.Misc. No.57072 of 2015 (2) dt.18-12-2015 2/2 reserved. There is counter version of the occurrence also. A statement has been made in paragraph 3 of the petition that the petitioner has no criminal antecedent.
The aforesaid facts constitute ground for consideration of prayer for regular bail. Let the learned Court below consider the prayer for regular bail of the petitioners, if the petitioners surrender within a period of six weeks in connection with Belchhi P.S. Case No.36/2015, pending before the learned SDJM, Barh, Patna.
With the above observation, this application is, accordingly, disposed off.
