ANJANA MISHRA ORAL ORDER 13-01-2017 Heard learned counsel for the petitioner and the learned counsel appearing on behalf of the State. The petitioner is apprehending his arrest in connection with Hajipur Town P.S. Case No.508 of 2016 for allegedly having committed the offence under Sections 379, 414/34 of the Indian Penal Code.
Learned counsel for the petitioner submits that, admittedly, recovery of motorcycle was made from one Abhishek Kumar and not from this petitioner. It is further submitted that on the basis of the statement made by the said Abhishek Kumar, the name of the petitioner has been brought in in connection with the present case.
Considering the aforementioned facts and circumstances and that the statement made before the police by
Patna High Court Cr.Misc. No.54732 of 2016 (2) dt.13-01-2017 2/2 co-accused has no evidentiary value and that the petitioner is having no criminal antecedents, let the petitioner, above named, in the event of his arrest or surrender before the court below within a period of four weeks from the date of receipt/production of a copy of this order, be released on bail on furnishing bail bond of `10,000/- (Ten thousand) with two sureties of the like amount each to the satisfaction of the learned Chief Judicial Magistrate, Vaishali at Hajipur, in connection with Hajipur Town P.S. Case No.508 of 2016, subject to the conditions as laid down under Section 438(2) of the Code of Criminal Procedure.
