JUSTICE DINESH KUMAR SINGH ORAL ORDER 11-12-2015 Heard learned counsels for the petitioner and the State. The petitioner is apprehending arrest in a case registered for the offences punishable under Section 395 of the Indian Penal Code.
The prosecution case is that 4-8 unknown miscreants committed dacoity in the house of the informant leading to registration of FIR against unknown. Name of the petitioner sprang up during investigation when co accused Gaurav alias Daru made exculpatory and inculpatory statement involving the petitioner and describing in details as how the booty was shared. It is submitted by the learned counsel for the petitioner that the petitioner was on inimical terms with Gaurav from before and that is why the petitioner has been named. There is no recovery from the petitioner. Statement has been made in
Patna High Court Cr.Misc. No.56266 of 2015 (2) dt.11-12-2015 2/2 paragraph 3 of the petition that the petitioner has no criminal antecedent.
Considering the fact that the petitioner's name sprang up in the confessional statement of co accused and the impugned order does not reflect any material collected against the petitioner, let the above named petitioner be released on anticipatory bail in the event of arrest or surrender before the learned Court below within a period of twelve weeks from today on furnishing bail bond of Rs. 10,000/- (ten thousand) with two sureties of the like amount each to the satisfaction of learned ACJM IX, Gaya in connection with Tekari P.S. Case No.394 of 2015 subject to the conditions as laid down under Section 438(2) Cr.P.C.
