JUSTICE SUDHIR SINGH ORAL ORDER 13-01-2016 Heard learned counsel for the petitioner and the State. The petitioner is apprehending his arrest in a case instituted under Sections 406, 419, 420, 467, 468 and 471/34 of the Indian Penal Code.

Allegation against the petitioner is that he along with others fraudulently got the lease deed executed for 61 years. Petitioner along with one Ashok Singh has fraudulently got loan of Rs.2.5 crores from the bank. When the matter was raised by the deceased, who was a Journalist in profession, he was killed in a planned conspiracy to hush up the same.

It has been submitted on behalf of the petitioner that he has got no criminal antecedent. He has been made accused due to mistake of fact. No offence at all is made out against the petitioner. Neither the bank nor the land owner has raised any objection about the forged sale deed or the sanctioned loan in favour of the petitioner and others. Petitioner has falsely been implicated at the instance of the police.

On behalf of the State, it is submitted that the petitioner is named in the F.I.R.

No.57271 of 2015 (2) dt.13-01-2016 2 / 2 Considering the aforesaid facts and circumstances, let the above named petitioner, in the event of arrest or surrender in the court below within a period of six weeks, be released on bail on furnishing bail bond of Rs. 10,000/- (Ten thousand only) with two sureties of the like amount each to the satisfaction of learned Chief Judicial Magistrate, Sitamarhi, in connection with Sitamarhi P.S. Case no. 816 of 2015, subject to the conditions as laid down under Section 438(2) of the Code of Criminal Procedure. (Sudhir Singh, J) sudip/- U T
