2. The petitioner apprehends his arrest in connection with Pakaridayal P.S. Case No. 147 of 2025, registered under Section 30(a) of the Bihar Prohibition and Excise Amendment Act.
3. As per the first information report, on a secret information, the police team, on search, recovered 70 liters of country made liquor from a bush and the same was seized.
4. Learned counsel for the petitioner submits that the seized article was recovered from a bush, which is an open place, where access of general public cannot be ruled out and the seized articles does not belong to the petitioner. Name of the petitioner has surfaced on the basis of statement local people, who are said to have seen the petitioner fleeing away from the place from where the articles are said to have been seized. Considering the submissions made by the learned counsel for the petitioner, the petitioner, above named, is directed to be released on anticipatory bail in the event of arrest or surrender before the court below within a period of four weeks from today on furnishing bail bond of Rs. 10,000/- (rupees ten thousand) with two sureties of the like amount each to the satisfaction of learned Exclusive Special Excise Court No.-3, East Champaran at Motihari, in connection with Pakridayal P.S. Case No. 147 of 2025 subject to the condition as laid down under Section 482 (2) of the B.N.S.S., 2023. (Ajit Kumar, J) Pawan/- U T
