2. The petitioner seeks bail in connection with Garahiya Bazar P.S. Case No. 97/2025 registered for the offences punishable under Sections 317(2), 317(4), 338, 336(3), 3(5) of the B.N.S.

3. As per the prosecution case, petitioner is found to be involved in theft of a motorcycle.

4. Learned counsel for the petitioner submits that petitioner is innocent and has falsely been implicated in the present case. Learned counsel further submits the petitioner is not named in the FIR and his name has surfaced in the confessional statement of co-accused Subash Sahani. Learned counsel lastly submits that petitioner has two criminal

Patna High Court CR. MISC. No.66109 of 2025(3) dt.24-09-2025 2/2 antecedents in which he is on bail and he is in custody since 26.05.2025. The petitioner undertakes to co-operate in the case/ trial.

5. Learned APP for the State has opposed the prayer for regular bail of the petitioner.

6. Considering the facts and circumstances of the case, this application for regular bail is allowed.

7. Accordingly, let the petitioner, above named, be released on bail on furnishing bail bonds of Rs. 10,000/- (Ten Thousand) with two sureties of the like amount each to the satisfaction of the learned S.D.J.M., Sikrahana Dhaka, East Champaran, Motihari/concerned Court below in connection with Garahiya Bazar P.S. Case No. 97/2025 subject to the condition:- The petitioner will mark his attendance at the Chakia Police Station on four days in every month preferably on every Sunday. Any default in appearance at the Police Station would result in cancellation of bail bond of the petitioner.
