The petitioner seeks bail in a case registered under Sections 323, 341, 353, 504, 506 of the Indian Penal Code and Section 37(C) of the Bihar Prohibition and Excise Act, 2016. The prosecution case, in short, is that the petitioner was apprehended in drunken state.

It has been submitted on behalf of the petitioner that the petitioner has got no criminal antecedent. There is no allegation of tampering of witnesses alleged against the petitioner. The petitioner is in custody since 05-08-2019. It is alleged that the petitioner was found in drunken state. There is no recovery of liquor in the present case.

On behalf of the State, it is submitted that the

Considering the aforesaid facts and circumstances, let the petitioner, above named, be released on bail on furnishing bail bonds of Rs.10,000/- (Ten thousand) with two sureties of the like amount each to the satisfaction of learned ADJ-II-cumSpecial Judge, Excise, Samastipur in connection with Hasanpur P.S. Case No. 168 of 2019.
