JUSTICE HEMANT KUMAR SRIVASTAVA ORAL ORDER 04-01-2016 Heard learned counsel for the petitioner as well as learned Additional Public Prosecutor for the State. According to prosecution case itself, earlier the victim was abducted by Shamshad who happens to be full brother of the petitioner and for the aforesaid offence, a criminal case was registered. The victim was recovered in the aforesaid case and her statement under Section 164 of the Cr.P.C. was recorded. The victim specifically stated in her statement that she had solemnized her marriage by her own sweet will with Shamshad. The contention on behalf of the petitioner is that the victim is residing with her husband namely Shamshad but the present case has been lodged by brother of the victim against the petitioner on the basis of false and concocted story.

No.58046 of 2015 (2) dt.04-01-2016 2/2 Considering the aforesaid facts and circumstances as well as submissions of the parties, let the petitioner, namely, Shahjad Mian be released on bail on furnishing bail bond of Rs.10,000/- (ten thousand) with two sureties of the like amount each to the satisfaction of Chief Judicial Magistrate, Gopalganj in connection with Mirganj P.S.
