JUSTICE ARUN KUMAR ORAL ORDER 11-01-2017 Heard learned counsel for the petitioner as well as learned Additional Public Prosecutor for the State. Petitioner seeks bail in a case registered under Sections 401, 414 and 120B of the Indian Penal Code. On receiving the secret information, the police apprehended the vehicle in which four persons were found. Learned counsel appearing on behalf of the petitioner submits that one of the occupants of the vehicle Vikram Prasad asked him to take away the vehicle to Sitamarhi to sell the said vehicle and therefore, he was driving the vehicle and he had no knowledge that vehicle was stolen. The co-accused Vikram Prasad has been granted bail by a Co-ordinate Bench of this Court by order dated 2.12.2016 passed in Cr. Misc. No.52071 of 2016 and

Patna High Court Cr.Misc. No.553 of 2017 (2) dt.11-01-2017 2/2 this petitioner has no criminal antecedent except he was remanded in another case, i.e., Nanpur P.S. Case No.192 of 2016 after lodging of this case under Sections 361 and 379 of the I.P.C. and the case of the petitioner stands on similar footing to Vikram Prasad.

Considering the aforesaid facts and circumstances and, in particular, that the case of the petitioner stands on similar footing to Vikram Prasad, the petitioner above named is directed to be released on bail on furnishing bail bond of Rs.10,000/- (ten thousand) with two sureties of the like amount each to the satisfaction of Sub-Divisional Judicial Magistrate, Pupri at Sitamarhi in connection with Pupri P.S. Case No.163 of 2016 with a condition that he shall remain physically present during the course of trial on each and every date. On failure to appear on two consecutive dates without any reasonable cause, his bail bonds shall be cancelled.
