The petitioners are apprehending their arrest in a case registered for the offences punishable under Sections 341, 323, 324, 307, 379, 504/34 of the Indian Penal Code.
The prosecution case is that the accused persons came to the house of the informant and started abusing. On protest being made co-accused Pradeep Sao assaulted with garasa on her head. It is further alleged that petitioner no.2 Soni Devi and Mausami Devi snatched silver chain from the informant.
It is submitted by the learned counsel for the petitioners that for petty dispute the accusation has been
Patna High Court Cr.Misc. No.56539 of 2015 (2) dt.14-12-2015 levelled. Only one lacerated wound has been caused to the informant. There is no specific accusation against the petitioner. Statement has been made in para-3 of the petition that petitioner has no criminal antecedent.
Considering the aforesaid facts, let the above named petitioners be released on bail in the event of their arrest or surrender before the learned court below within a period of twelve weeks from today, on furnishing bail bonds of Rs. 10,000/- (Ten Thousand) each with two sureties of the like amount each to the satisfaction of learned Chief Judicial Magistrate, Begusarai in connection with Baliya P.S. Case No. 312 of 2015, subject to conditions as laid down under Section 438(2) of the Code of Criminal Procedure.
