1. Learned counsel for the Petitioners produces a Demand Draft of `One lac drawn by the Petitioner No.1 in favour of the Opposite Party No.2 as full and final settlement.

2. Counsel for the Opposite Party No.2 accepts the same and signs in the margin of the order-sheet in token of receipt of the same.

3. Having gone through the nature of dispute which is financial in nature and the Petitioner has paid `One lac which the Opposite Party No.2 has accepted, it would be in their interest to end the dispute now.

4. Hence, entire proceeding including the order of

Patna High Court Cr.Misc. No.38933 of 2013 dt.02-07-2015 2/2 cognizance dated 10.06.2013 passed by the Judicial Magistrate, 1st class, Bhagalpur, in Complaint Case No.429 of 2011 is hereby set aside.

5. The application stands allowed.

6. However, this order shall not give undue advantage to any party.
