JUSTICE VIKASH JAIN ORAL JUDGMENT Date: 20-08-2018 The present writ petition has been filed for quashing the order dated 11.11.2008 passed by the Divisional Commissioner, Patna dismissing the restoration petition filed by the petitioner, the appellate order dated 16.11.1998 in Rev. Misc. No. 40/98-99 passed by the District Magistrate, Bhojpur ar Ara as also the order dated 18.07.1998 passed by the Sub Divisional Officer, Sadar. Ara by which the licence of the petitioner's Fair Price shop bearing no. 20/85 has been cancelled and monthly allotment has been stopped; and further to restore the petitioner's licence.

2. At the very outset this Court takes note that against the order of dismissal of petitioner's revision petition on 26.10.2004 the petitioner

Patna High Court CWJC No.19810 of 2015 dt.20-08-2018 had approached the Commissioner for restoration by filing a petition on 20.10.2006 which was not entertained owing to inordinate delay and stood rejected by the impugned order dated 11.11.2008. There is considerable delay and laches on the part of the petitioner also in approaching this Court against the said order dated 11.11.2008 after a lapse of more than seven years in December, 2015 without any explanation for such delay.
