JUSTICE DINESH KUMAR SINGH ORAL ORDER 03/ 07-03-2018 As prayed for, learned counsel for the petitioner is permitted to make necessary correction in the petition and also to convert this application from anticipatory bail application to modification application.
The petitioner has renewed the prayer for anticipatory bail being husband of the information in a case registered for the offences punishable under Section 498A of the Indian Penal Code and Sections 3/4 of Dowry Prohibition Act. However, learned counsel for the petitioner submits that the petitioner, in fact, has filed the present application for modification of order dated 29.08.2016 passed in Cr. Misc. No.
Patna High Court Cr.Misc. No.1876 of 2017 (3) dt.07-03-2018 3454 of 2016, as contained in Annexure-1, to the extent of extending the period of surrender.
The petitioner's earlier anticipatory bail application was disposed of vide order 29.08.2016 passed in Cr. Misc. No. 3454 of 2016 with liberty to the learned Court below to consider the prayer for regular bail of the petitioner, if the petitioner surrenders within a period of six weeks. Considering the confined prayer of the learned counsel for the petitioner the order dated 29.08.2016 passed in Cr. Misc. No. 3454 of 2016 is modified to the extent that the period of surrender is extended by four weeks from the date of receipt/production of a copy of this order in connection with Barauli P.S. Case No. 241 of 2013, pending in the Court of learned Chief Judicial Magistrate, Gopalganj. Accordingly, this application is disposed of. (Dinesh Kumar Singh, J) DKS/- U T
