Patna High Court CWJC No.17212 of 2022(2) dt.09-04-2024 2/3 Panchayat Sirdala, District-Nawada as Petitioner's name is figuring at Serial No. 2 in the merit list and the candidate figuring at Serial No. 1 has been removed due to forgery committed by her in passing matriculation examination twice in different names.

(ii) For issuance of an appropriate writ, order, direction to the official respondent to consider the candidature of petitioner for employment on the post of Anganbari Sewika as per her merit in the merit list.

(iii) For issuance of appropriate writ, order, direction to employ the petitioner on the post of Anganbari Sewika as per the Certificate of candidate figuring at Serial No. 1 has been declared illegal and petitioner is at Serial No. 02 next to the candidate figuring at Serial No. 1."

At the outset, the learned counsel for the petitioner seeks not to press the present writ petition, however, seeks liberty on behalf of the petitioner to avail such other alternative remedies as are otherwise available under the law, including that of filing a civil suit before the learned civil court of competent jurisdiction. Liberty, so sought, is granted.
