The petitioner is apprehending arrest in a case registered for the offences punishable under sections 341,342,324,307,379 and 504/34 of the Indian Penal Code. It is alleged that the petitioner along with two others intercepted the informant and caused injury near left eye. Other accused persons assaulted the informant by means of khukhri and rod, thereafter the petitioner snatched two lacs rupees and mobile. It is submitted by the learned counsel for the petitioner that the accusation does not suggest that the case comes within the purview of section 307 IPC. There is no recovery from
Patna High Court Cr.Misc. No.56911 of 2015 (2) dt.17-12-2015 2/2 the petitioner and the petitioner has also filed complaint case against the informant. Statement has been made in paragraph 3 of the petition that the petitioner has no criminal antecedent. The aforesaid facts constitute ground for consideration of the prayer for regular bail of the petitioner by the learned court below in case the petitioner surrenders within six weeks from today in connection with Forbesganj P.S. Case No. 264 of 2015 pending in the court of learned CJM, Araria. This application is disposed of with the aforesaid observation/direction.
