JUSTICE MOHIT KUMAR SHAH ORAL ORDER 19-06-2023 The short prayer made by the petitioner, in the present writ petition, is to direct the Circle Officer, Kaluahi, District-Madhubani to conclude the proceedings of the pending Encroachment Case No.06 of 2020-21.

Learned counsel for the respondent-State submits that in case the aforesaid encroachment proceedings are still pending, the same shall definitely be concluded, within a stipulated time frame, as fixed by this Court. Having regard to the facts and circumstances of the present case, I deem it fit and proper to direct the Circle Officer, Kaluahi, District-Madhubani to conclude the proceedings of the

Patna High Court CWJC No.16012 of 2022(2) dt.19-06-2023 2/2 aforesaid Encroachment Case No.06 of 2020-21, in case the same has not already been concluded, by passing the final order under Section 6(1) of the Bihar Public Land Encroachment Act, 1956, after hearing the affected parties and in accordance with law, within a period of six weeks of receipt/production of a copy of this order.

The writ petition stands disposed off on the aforesaid terms.
