The petitioner apprehends his arrest in connection with Forest Case No. 27 of 2022 registered under Sections 33, 41 and 42 of the Indian Forest Act.

Submission of learned counsel for the petitioner is that petitioner is quite innocent and has falsely been implicated in the present case. There is general and omnibus allegation against him. Further submission is that petitioner is not named in the first information report and there is no criminal history against him.

Learned A.P.P. appearing on behalf of the State opposed the prayer of the petitioner by contending that the vehicle, from

Patna High Court CR. MISC. No.64501 of 2022(2) dt.10-01-2023 2/2 where the alleged recovery has been made, belongs to the petitioner. Hence, petitioner does not deserve to be enlarged on anticipatory bail.

Having considered the facts and circumstances of the case and nature of the allegation, this Court is not inclined to grant anticipatory bail to the petitioner. Accordingly, prayer of the petitioner is rejected.
