JUSTICE VINOD KUMAR SINHA ORAL ORDER 05-11-2019 This application, for grant of anticipatory bail, arises out of Desari (Sahdei O.P.) P.S. Case No. 85 of 2019, disclosing offences under Sections 363, 366, 498 and 34 of the Indian Penal Code.

Petitioner is named in the F.I.R. and there is allegation is of kidnapping the daughter of informant.

Submission of learned counsel for the petitioner is that the girl has been recovered and her statement has been recorded after three months of her recovery and though, she has stated that petitioner and other accused persons have taken away her but she has not stated about any overt act by the petitioner. Heard learned A.P.P. also.

Having heard both sides, considering the facts and

No.69450 of 2019(2) dt.05-11-2019 2/2 circumstances, I am not inclined to grant the privilege of anticipatory bail to the petitioner rather petitioner has to surrender before the court below and make prayer for regular bail and if any such application is filed, the court below will dispose of the same on the merit of the case, if possible on same day, without being prejudiced by this order.
