JUSTICE DINESH KUMAR SINGH ORAL ORDER 08-01-2016 The petitioner has renewed his prayer for anticipatory bail in a case registered for the offences punishable under Sections 323, 379, 498A and 504/34 of the IPC and Section 3/4 of the Dowry Prohibition Act.
The basic accusation is of torture for non-fulfillment of the dowry demand.
Considering the fact that on merits a co-ordinate Bench of this Court dismissed the prayer for anticipatory bail vide order dated 23.07.2015 passed in Cr. Misc. No. 17158 of 2015, this Court is not inclined to interfere.
However, let the learned court below consider the prayer for regular bail of the petitioner if he surrenders within a period of six weeks in connection with Darbhanga Mahila P.S. Case No. 96 of 2014 pending in the court of learned SDJM,
Patna High Court Cr.Misc. No.57682 of 2015 (2) dt.08-01-2016 2/2 Darbhanga keeping in view that the petitioner is ready to keep the informant as wife with full dignity and honour, statement to that effect has been made in para 11 of the petition, which reads as follows:- "That it is asserted here that the petitioner is always ready and willing to keep the informant with full honour and dignity.."
