2. The present writ petition has been filed for the following relief/s:- "I. For issuance of a writ in nature of a quo
2/4 warranto against the respondent no.7 who has got appointment illegally on the basis of forged and fabricated document at the time of selection process and appointing authority also has acted in collusion of respondent no. 7 in illegally in this regard and on this ground respondent no. 7 be removed from the post of Vikas Mitra of panchayat Lamichaur, Block- Bhore and action of the appointment authority is arbitrary, mala fide and violation of principle of natural justice.
II. For issuance of appropriate writ in nature of Mandamus / directing / commanding to the respondents to issue the appointment letter for the post of Vikas Mitra to the petitioner as perfect and able candidate for post of Vikas Mitra, after removing /setting aside the appointment of respondent no. 7 from the post of Vikash Mitra who has secured her selection/appointment illegally on the basis of forged and fabricated documents i.e.
possess two Matriculation marks sheet, two cast certificate in which father name is different and also from perusal of parents aadhar card, voter list as well Government ration card it would be clear that she has obtained forged and fabricated documents to mislead the appointing authority in
3/4 getting appointment on the post of vikas mitra, in pursuance of Advertisement Letter No.Vi.Am.Bhi.Am (Vi.Mi.Ch.) XXII01/23/1584 dated- 16.10.2023 issued by District Welfare Office, Gopalganj.
III. To grant any other relief/s for which the petitioner is entitle in eye of law."
3. Learned counsel appearing for the Bihar Vikash Maha Dalit Mission (B.M.V.M.) raised preliminary objection and submits that the first relief with regard to the issuance of quo warranto is not permissible due to the reason that the post on which Respondent No. 7 was working was not a public post.
4. In the light of the submissions made by counsel for the B.M.V.M., counsel for the petitioner submits that he is not interested to press the first relief.

Learned counsel for the State, on the other hand, submits that the Respondent No. 7 has been restrained from continuing on her post till verification of the documents in compliance of the order passed by the Bihar Mahadalit Vikash Mission, Patna vide Letter No. BMVM-1210-01/24-114 dated 14.01.2025. He also submits that in the light of the stand taken in Annexure-R/B, the grievance of the petitioner is no more in existence. As per the letters annexed as Annexure-R/B and
4/4 Annexure-R/C, it is clear that the enquiry has been started against the Respondent No. 7.
6. In this background, this Court is of the view that grievance of the petitioner has settled and the present case has now become infructuous.

It is expected that the Respondent-Bihar Mahadalit Vikash Mission as well as the concerned authority at the level of whom the enquiry against Respondent No. 7 has been initiated, shall conclude the enquiry within a reasonable period of time, preferably not exceeding three months. Liberty is hereby granted to the petitioner to file an appropriate application before the concerned District Magistrate if the enquiry is not concluded within three months from the date of production of this order.
8. Accordingly, with the aforesaid observation, this writ petition stands disposed off.
