The Petitioner seeks bail in Makhdumpur P.S. Case No. 23 of 2016 instituted for the offence under Section(s) 302 of the Indian Penal Code pending in the Court of Additional Sessions Judge 5, Jehaband.
The petitioner is said to be the main assailant in the written report. The Sessions Judge in the impugned order has noted that two witnesses have already been examined. There is specific allegation against the petitioner of cutting neck of the informant.
In the facts and circumstances of the case, I am not inclined to grant the privilege of bail to the petitioner.
