The petitioners are apprehending arrest in a complaint case wherein process has been directed to be issued after cognizance being taken for the offences punishable under sections 406 of the IPC and Section 138 of N.I. Act.

The case of the complainant is that the complainant supplied stone chips worth Rs.6,66,995/- and also paid Rupees One Lac through cheque. Subsequently, the petitioners issued cheque in favour of Ajay Kumar, which got dishonoured on the ground of insufficient fund in the bank account. It is submitted by learned counsel for the petitioners that petitioners are representatives of Ultra Tech Cement Company

Patna High Court Cr.Misc. No.1588 of 2018(2) dt.11-01-2018 2/2 and entire payments have been made concerning the supply of stone chips and the cheque was admittedly not issued in favour of the complainant. Moreover, stone chips were supplied to the Ultra Tech Cement Company and not the petitioners. Considering the nature of accusation arising out of contractual relationship between the parties, let the petitioners above named be released on anticipatory bail in the event of arrest or surrender within 12 weeks on furnishing bail bond of Rs.10,000/- (ten thousand) each with two sureties of the like amount each to the satisfaction of the learned ACJM II, Hilsa, Nalanda in connection with Complaint Case No. 620 C of 2016, subject to the conditions laid down in Section 438 (2) of the Cr.P.C.
