JUSTICE ANIL KUMAR UPADHYAY ORAL JUDGMENT Date: 06-03-2018 Heard learned counsel for the petitioner and State. This writ application has been filed on 06.01.2016 after service of two advance copies to the office of learned Advocate General. More than two years have passed, but neither the grievance of the petitioner has been redressed nor counter affidavit has been filed.

In the aforesaid circumstances, the writ application is disposed of with a direction to the District Education Officer, Nalanda (respondent no.3) to take final decision with regard to the claim of the petitioner for grant of promotion positively within a period of 60 days from the date of receipt/production of a copy of this order and in case

Patna High Court CWJC No.332 of 2016 dt.06-03-2018 2/2 the petitioner is found entitled for grant of selection grade or other promotional benefits, the same should be extended to the petitioner within the aforesaid period of 60 days.

It is made clear that if any person, junior to the petitioner, has been granted the benefit of selection grade or other promotional benefit, the same benefit should also be granted to the petitioner and necessary consequential monetary relief must reach to petitioner within a period of one month from the date of such decision by the respondent no.3.
