JUSTICE ARUN KUMAR ORAL ORDER 15-01-2018 Heard learned counsels for the petitioner and the State. The petitioner, already in custody, seeks bail in connection with Jehanabad P.S.Case No. 205 of 2014 registered under Sections 328, 376 and 511/34 of the Indian penal Code. Allegation in brief is that petitioner, a lady cook of the Remand Home, used to mix sedative in the food to serve to Manju Devi residing in the Remand Home and when she became unconscious in the night, a person used to sexually exploit her. Learned counsel for the petitioner submits that petitioner is a lady cook of the Remand Home, there is no evidence recorded in the case diary during investigation that what sedative was mixed in the food, even the statement of the so-called victim has not been recorded nor she was medically examined and the petitioner is in custody since 21.10.2016.

No.59361 of 2017 (3) dt.15-01-2018 2/2 Having considered the aforesaid facts and circumstances, the petitioner, namely , Tetari Kunwar, is directed to be released on bail upon furnishing bail bond of Rs. 10,000/- with two sureties of the like amount each to the satisfaction of the learned Additional Sessions Judge-2nd, Jehanabad in connection with S.T. No. 565/216, 158/2016 arising out of Jahanaad P.S. Case No. 205 of 2014, with condition that one of the bailor must be his close family relative. Petitioner shall remain physically present on each and every date during trial and in case of failure on two consecutive dates without any medical urgency, her bail bond shall liable to be cancelled.
