JUSTICE VINOD KUMAR SINHA ORAL ORDER 24-09-2019 Petitioner seeks bail in anticipation of his arrest in connection with Bihar P.S. Case No. 475 of 2018 registered for the offences punishable under Sections 30(a), 37(b) and (c) of Bihar Prohibition and Excise Act.

Allegation is of recovery of 60 and odd litres of liquor from Tata Indigo car and petitioner is said to be owner of the said car.

Submission of learned counsel for the petitioner is that he is not the owner of the vehicle and there is no allegation against him.

Heard learned APP, who has opposed the prayer for anticipatory bail of the petitioner.

In view of above facts and circumstances, this application is disposed of with direction to the petitioner to

Patna High Court CR. MISC. No.60719 of 2019(2) dt.24-09-2019 2/2 surrender within a period of two weeks from the receipt of this order and on surrender learned Special Judge shall verify the ownership of the vehicle from the case diary and if the submission of petitioner is found to be correct that he is not the owner of the vehicle, learned court below shall release him on bail to its own satisfaction, otherwise petitioner has to surrender and pray for regular bail.
