JUSTICE DINESH KUMAR SINGH ORAL ORDER 12-12-2017 Heard learned counsels for the petitioners and State. The petitioners are apprehending arrest in a case registered for the offences punishable under Sections 147, 148, 341, 323, 324, 337, 307, 379, 504 and 506 of the IPC.
The prosecution case is that on 17.06.2017 at 7 PM, while the informant was sitting at his door, his niece came crying and informed him that her uncle is causing hurt to her grandmother. She also informed that the mother of Mukesh Ram assaulted her and when the informant made protest, he was also being assaulted and when the sister of the informant, Maniya Devi came to rescue, the accused persons also assaulted her and father of the informant and snatched gold chain from the sister

It is submitted by learned counsel for the petitioners that the specific accusation of assault is against male persons, Mukesh Ram, Binde and Umesh. The petitioners are ladies and there is no specific accusation of assault against them. The present case has been lodged as a counter blast to Biraul P.S. Case No. 37 of 2017, which was registered at the behest of the petitioners' side against the informant's side prior to the present case. A statement has been made in paragraph no.3 of the petition that the petitioners have no criminal antecedent.
Considering the fact that the petitioners are ladies and accusation against them is omnibus and general, let the above named petitioners be released on anticipatory bail in the event of arrest/surrender before the learned Court below within a period of twelve weeks from today, on furnishing bail bonds of Rs. 10,000/- (ten thousand) each with two sureties of like amount each to the satisfaction of learned ACJM, Biraul in connection with Biraul P.S. Case No. 288 of 2017, subject to the condition as laid down under Section 438(2) of the Cr. P.C.
