2. The petitioner apprehends her arrest in a case registered for the offence under Sections 316(2), 318(4), 351(2), 352, 61(2), 111(2), 3(5) of the Bhartiya Nyaya Sanhita, 2023.

3. In lieu of providing job in police department on the post of 'Constable', all the F.I.R. named accused persons including this petitioner, took total Rs. Nine Lakhs through cash and UPI, but they neither provided him job nor returned the alleged money.

4. Learned counsel for the petitioner submits that petitioner has been made accused in this case merely because

Patna High Court CR. MISC. No.64926 of 2025(2) dt.17-09-2025 2/3 informant has deposited Rs. 56,000/- in her bank account, which she is ready to return in the Nazarat of the concerned Civil Court. Petitioner is lady and claims clean antecedent.

5. Learned A.P.P. for the State opposes the bail petition.

Considering the aforesaid facts and circumstances, let the above named petitioner, in the event of arrest/surrender within a period of eight weeks from today, be enlarged on bail on furnishing bail-bond of Rs. 10,000/- (ten thousand) with two sureties of the like amount each to the satisfaction of learned Chief Judicial Magistrate, Motihari, East Champaran / concerned Court in connection with Malahi P.S. Case No. 120 of 2025, subject to condition as laid down under Section 482 of the Bhartiya Nagrik Suraksha Sanhita, 2023, with further following conditions:

"(A) At the time of furnishing bail-bond, the petitioner shall deposit Rs. 56,000/- (Fifty six thousand) in the Nazarat of concerned Civil Court and receipt of the same shall be furnished along with bail-bond.

(B) The aforesaid payment shall be subject to final outcome of the case.

(C) If petitioner fails to comply the direction of this Court, the learned Court below would be at liberty to cancel the bail-bond of the petitioner."

7. This order has been passed, without going into the merit of the case, only for the purpose of considering the prayer for anticipatory bail of petitioner.
