JUSTICE VINOD KUMAR SINHA ORAL ORDER 20-11-2019 This is an application for grant of anticipatory bail in connection with Warsaliganj P. S. Case No. 314 of 2018, disclosing offences under Sections 341, 323, 504, 307, 326, 379, 34 of IPC.

As per F.I.R. the accused persons have started ploughing the land of the informant, for which, he protested, thereafter, there is allegation that petitioner and Ranjit Choudhary assaulted by Sword on the head of the informant, but the same hit on his waist, causing injury.

Submission of the learned counsel for the petitioner is that there is case and counter case between the parties and the scuffle took place only because water from the field of the petitioner entered inside the field of the informant and there is general allegation against the petitioner and one other co-

Heard learned A.P.P. also, who has opposed the prayer for anticipatory bail on the ground that fracture injury was found by the PMCH on waist of the informant.

Having heard both sides, considering the above submission, this application is allowed. Let the petitioner, above named, in the event of his arrest or surrender before the court below within six weeks, be released on bail on furnishing bail bond of Rs.25,000/- (Rupees Twenty Five Thousand) with two sureties of the like amount to the satisfaction of learned A.C.J.M., 1st, Nawada, in connection with Warsaliganj P. S. Case No. 314 of 2018, subject to the condition laid down under Section 438(2) of the Code of Criminal Procedure. (Vinod Kumar Sinha, J) Sunil Shukla/- U T
