For the Petitioner/s : Mr. Umesh Kumar Singh For the Opposite Party/s Mr. Abhay Kumar Roy(App) ====================================================== CORAM: HONOURABLE MR. JUSTICE HEMANT KUMAR SRIVASTAVA ORAL ORDER 02/ 04.05.2016 Heard learned counsel for the petitioner as well as learned Addl. Public Prosecutor for the State.
Petitioner apprehends her arrest in connection with Ghorasahan P. S. case no. 56/2014 registered under section 307 and other allied sections of the Indian Penal Code. Earlier prayer for anticipatory bail of the petitioner was rejected by this court vide order dated 2.2.2015 passed in Cr. Misc. no. 32005/2014 but second bail petition has been filed on behalf of the petitioner on the ground that father-in-law of the victim has sworn affidavit to this effect that victim accidentally sustained injury. I do not find any fresh ground to reconsider prayer for anticipatory bail of the petitioner and accordingly, prayer for anticipatory bail in connection with Ghorasahan P. S. case no. 56/2014 pending in the court of Sri S.K.Mishra, Judicial Magistrate, Ist Class, Sikrahana, East Champaran at Motihari is, again, rejected.
Patna High Court Cr.Misc. No.8710 of 2016 (2) dt.04-05-2016 However, if the petitioner surrenders and seeks regular bail within four weeks from the date of receipt/production of a copy of this order, the concerned court shall consider regular bail application of the petitioner on its own merit without being prejudiced by this rejection order.
