ANJANA MISHRA ORAL ORDER 22-01-2016 Heard learned counsel for the petitioners and learned counsel appearing on behalf of the State.

The petitioners are apprehending their arrest in connection with Bhabhua (Sonhan) P.S. Case No. 589 of 2015, registered for offences punishable under Sections 438, 323, 504, 379, 341, 307/34 of the Indian Penal Code.

Learned counsel for the petitioners submits that there is a case and counter case between the parties. Admittedly, an altercation took place between the parties in which both the parties have sustained injuries. Learned counsel for the petitioners fairly submits that one of the persons said to have been attacked, has received grievous injuries. He further submits that there was a land dispute between the parties with regard to cultivation of land

Patna High Court Cr.Misc. No.58153 of 2015 (2) dt.22-01-2016 2/2 belonging to State of Bihar, which became the bone of contention between the parties leading to the altercation. Thus the learned counsel for the petitioners submits that the petitioners have no criminal antecedent, and, therefore, they may be extended the privilege of anticipatory bail.

Considering the nature of allegation made against the present petitioners and also the fact that the petitioners have no criminal antecedent, let the petitioners above named, in the event of their arrest or surrender before the court below within a period of four weeks from the date of receipt/production of a copy of this order, be enlarged on bail on furnishing bond of Rs. 10,000 (Rs. Ten Thousand) each with two sureties of the like amount each to the satisfaction of learned Chief Judicial Magistrate, Kaimur at Bhabhua in connection with Bhabhua (Sonhan) P.S. Case No. 589 of 2015, subject to the conditions as laid down under Section 438(2) of the Cr.P.C.
