JUSTICE JITENDRA MOHAN SHARMA ORAL ORDER 09-03-2016 Heard the learned counsel for the petitioner as well as the learned A.P.P for the State.

The petitioner seeks bail in a case for the offences punishable under sections 25 (1-b) a, 26 and 35 of the Arms Act. Allegedly, acting on a tip off that Mewalal Vishwakarma is running a mini gun factory in the house of Kuleshwar Yadav at village- Jalalpur, raid was conducted and during raid four persons, namely, Mewalal Viswakarma, Nandlal Yadav, Ranjit Kumar (petitioner) and Umesh Mahto were apprehended and from the said house one country made rifle, one country made pistol, four live cartridges, drill machine, Gas Cylinder including other articles, as per the seizure list, were recovered.

Submission is that nothing has been recovered from

Patna High Court Cr.Misc. No.57871 of 2015 (4) dt.09-03-2016 2/2 the conscious possession of the petitioner and he is in custody since 01.09.2015, other co-accused Nandlal Yadav has been allowed bail vide Cr. Misc. No. 58591 of 2015 by another coordinate Bench of this Court.

The learned A.P.P. submits that the petitioner has got criminal antecedent and earlier also he was involved in Nawada Town P.S. Case No. 559 of 2012 for the offences under sections 25 (1-b) a, 26 and 35 of the Arms Act.

In the facts and circumstances as stated above, considering that co-accused Nandlal Yadav has been allowed bail and as such the petitioner is also directed to be released on bail on furnishing bail bond of Rs. 10,000/- (Ten thousand) with two sureties of the like amount each to the satisfaction of S.D.J.M. Nawada in Akbarpur P.S. Case No. 214 of 2015, subject to the conditions that one of the bailors must be a near relative and another having sufficient immovable property within the territorial jurisdiction of the court concerned and the petitioner shall remain present on each and every date during trial and the default on two consecutive dates on his part without any reason shall disentitle the petitioner from privilege of bail.
