JUSTICE ARUN KUMAR ORAL ORDER 14-12-2017 Heard learned Counsel for the petitioner and the State. Petitioner, already in custody, seeks bail in Jamui PS Case No. 322 of 2017 registered under Sections 323, 337, 338, 307, 153A and 295 of the IPC.

The allegation in brief is that the petitioner along with large number of people committed communal tension and disturbance on the occasion of Tajia and out of the mob someone also opened firing. Learned Counsel for the petitioner submits that there is no specific overt act alleged against the petitioner and another coaccused Nitesh Kumar, Ankit Keshri and Shrawan Kumar have been granted bail by a coordinate Bench of this Court. Having considered the said facts and circumstances, the petitioner, namely, Kanhai Ram @ Kanhaya Ram is directed to be released on bail on furnishing bail bonds of Rs. 10,000/- (ten thousand) with two sureties of the like amount each to the satisfaction of CJM Jamui in connection with Jamui PS Case No. 322 of 2017.
