1. Heard learned counsel for the parties.
2. The petitioner has preferred this application for grant of regular bail in connection with Ara Muffasil P.S. Case no. 269 of 2022 registered under sections 25(1-B)(a), 26 and 35 of the Arms Act
3. As per the prosecution case, the informant states that five pistols and more than 90 rounds of cartridges were recovered from the place disclosed by the co-accused Atul Pandey. It is further stated that the said Atul Pandey disclosed that he had been provided arms and ammunitions by the petitioner herein.
4. Learned counsel for the petitioner submits that no incriminating article has been recovered from the petitioner's
Patna High Court CR. MISC. No.63917 of 2022(2) dt.29-04-2023 2/2 possession. The name of the petitioner transpired in the confessional statement of the co-accused made before police. He has no criminal antecedent. He is in custody since 16.8.2022 and investigation in the case has concluded.

Having heard learned counsel for the parties and taking into consideration the nature of allegation, no incriminating article having been recovered from the petitioner's possession who is in custody for more than 8 months since 16.8.2022, chargesheet having been submitted in the case and petitioner not having any criminal antecedent, the petitioner is directed to be enlarged on bail in connection with Ara Muffasil P.S. Case no. 269 of 2022 on furnishing bail bond of Rs.10,000/- (Rupees Ten Thousand) with two sureties of the like amount each to the satisfaction of the learned Additional Chief Judicial Magistrate VII, Bhojpur at Ara.
