JUSTICE VINOD KUMAR SINHA ORAL ORDER 17-01-2017 Heard learned counsel for the petitioner as well as learned Addl. Public Prosecutor.

The application is for grant of bail in connection with Barari PS case no. 207 of 2015 for the offence under Sections 328, 302/34 of the Indian Penal Code.

It is submitted on behalf of petitioner that only on the basis of suspicion, petitioner along with others has been implicated in this case. As a matter of fact, petitioner is a widow and there is no occasion for the petitioner to visit the house of the deceased. It is further submitted that petitioner is in custody since 11.08.2016.

Heard learned A.P.P. also. Learned A.P.P. has opposed the prayer for bail and submitted that there is allegation against the petitioner of giving poison to the daughter of informant

Patna High Court Cr.Misc. No.813 of 2017 (2) dt.17-01-2017 2/2 and it has been supported by witnesses during course of investigation Having heard both sides. Considering the fact that there is allegation against the petitioner of giving poison to the daughter of informant which has been supported by other co-accused also, I am not inclined to grant bail to the petitioner. As such, his prayer for bail rejected. However, lower court is directed to expedite the trial taking into consideration the fact that petitioner is a lady.

With these observations, this bail application is dismissed.
