The writ application has been filed for direction to the respondents to expeditiously investigate Patna Kotwali P.S. Case No. 423 of 2016 a case registered under Section 420 and 406 of the Indian Penal Code as well as Section 138 of the Negotiable Instrument Act.

The State-respondents have stated in their counter affidavit that one of the accused has already surrendered in this case and warrant of arrest has already been received against another accused who is absconding. The collection of evidence is almost complete.

Hence, the police would file counter affidavit within

Patna High Court Cr. WJC No.59 of 2017 (3) dt.18-09-2017 2 /2 two months positively.

Considering the statement of the respondents, this writ application is being disposed of with a direction to the respondent-authorities to conclude the investigation and submit charge sheet within the aforesaid period.
