The petitioner apprehends her arrest in a criminal prosecution registered under Section 366A of the Indian Penal Code.
Though, the petitioner is not specifically named in the FIR vide Annexure-1 as an accused, but taking into consideration the fact that the victim girl Runjan Kumari aged about 14 years has specifically named this petitioner in her statement recorded under Section 164 Cr.P.C. (Annexure-3 to the supplementary affidavit filed on behalf of the petitioner) as one of the important culprit, who actively participated in the crime in question, and in her house the victim was kept for 10-12 days and she was criminally misbehaved by other accused persons, this Court is not inclined to accede to the prayer made on her behalf for grant of anticipatory bail. Accordingly, her prayer for grant of anticipatory bail in connection with Barh P.S. Case No. 02 of 2015 pending in the court of learned A.C.J.M., Barh is hereby rejected.
Patna High Court Cr.Misc. No.1806 of 2016 (3) dt.12-02-2016 However, if the petitioner surrenders in the court below within a period of one month from today and applies for regular bail, then the same shall be considered and decided on its own merits without being prejudiced by the present order.
