2. The petitioner is in custody in a case registered for the offence punishable under Sections 274, 275, 3(5) of the Bhartiya Nyaya Sanhita, 2023 and Sections 30(a), 30(b) and 30(c) of the of the Bihar Prohibition and Excise Act, 2022.

3. As per allegation in the FIR, different types of illicit liquor has been recovered from a motorcycle bearing registration no.BR-06CG-9515.

4. Learned counsel for the petitioner submits that petitioner has falsely been implicated in this case. He next submits that he has no concern with the said recovery as also said vehicle and nothing has been recovered from the possession

Patna High Court CR. MISC. No.66976 of 2025(2) dt.24-09-2025 2/2 of the petitioner, petitioner has got clean antecedent as stated in para-3 of the petition and he is in custody since 29.07.2025

5. Learned APP for the State opposes the prayer for bail of the petitioner.

In view of the aforesaid facts and circumstances, let the above named petitioner be released on bail on furnishing bail bond of Rs.10,000/- (ten thousand) with two sureties of the like amount each to the satisfaction of learned Exclusive Special Excise Court No.-III, Muzaffarpur in connection with Hathauri P.S. Case No. 124 of 2025.
